After a year in the White House, Jo Biden limped along with a stalled legislative agenda, a stubborn pandemic and Vladimir Poutine threatening Ukraine. It was a tired brand in desperate need of a revival, a difficult request at the age of 79.

Etienne Breyer provided it, instantly changing the conversation. A vacancy on the highest court allows Biden to rally the Democratic base and begin to cement a legacy that, despite initial ambitions, had recently seemed under threat.

Although the ideological balance of the court will not change, Biden could choose a young liberal who will serve for decades.

And Biden raised expectations. During a debate during the 2020 Democratic primary, he said, “I can’t wait to make sure there’s a black woman on the Supreme Court, to make sure we actually get all the representations.”

So far, his judicial appointments have been historically diverse, and Jen Psaki, the White House press secretary, told reporters after Breyer’s impending retirement was announced that Biden was “certainly keeping” his promise.
